NON-PAYMENT TRIAL INFORMATION

  1. Original Deed and/or Certified Copy* of the Deed (a Plain Copy of the Deed is not sufficient);
  2. Certified Copy of the Multiple Dwelling Registration (M.D.R.). Statement on file with DHPD. (A Plain Copy of the M.D.R. and/or M.D.R. Receipt is not sufficient);
  3. If the Apartment is a Rent-Stabilized Apartment, the Apartment Rent Registration filed with the DHCR for the building and for the individual apartment going to Trial (The Blue Sheet Building Wide Statement and Apartment Registration statement clocked in by DHCR is sufficient)*;
  4. Original Lease and any Renewal Leases;
  5. Detailed Computerized Rent Breakdown;
  6. Testimony by a witness that the rent was demanded three days before the commencement of the Non-Payment proceeding in the event that our firm did not prepare and serve a written Three Day Rent Demand.

HOLDOVER TRIAL INFORMATION

  1. Original Deed and/or Certified Copy* of the Deed (a Plain Copy of the Deed is not sufficient); 
  2. Certified Copy of the Multiple Dwelling Registration (M.D.R.). Statement on file with DHPD. (A Plain Copy of the M.D.R. and/or M.D.R. Receipt is not sufficient);
  3. Original Lease and any Renewal Leases;
  4. Detailed Computerized Rent Breakdown;
  5. Additionally, on the date of Trial, the Landlord must be prepared and have with him in Court any witnesses whom are ready and able to testify about any alleged occurrence which is the basis for this Holdover Proceeding. For example, if your case involves nuisance conduct on the part of the Tenant and/or Occupant, a witness for the Landlord with personal knowledge must be in Court to testify about the alleged nuisance conduct. This office will not be able to obtain a Final Judgment to Evict a Tenant without testimony by an individual who has personal knowledge.

Please Note that failure to notify us in advance, after receipt of this letter that no representative can be present in Court on the above date and time, may result in the dismissal of your case.
